These Terms of Service ("Terms") govern your use of the Kontinental mobile application (the "App"), operated by the developer of Kontinental ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use the App. By using the App, you represent that you are 13 or older and are able to form a binding contract with us.
You sign in using your email address and a one-time code. You are responsible for maintaining access to your email account and for activity that occurs under your account. Notify us promptly of any unauthorized use.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms and to Apple's Licensed Application End User License Agreement.
The App lets you create and share content, including photos, videos, places, trips, posts, and comments ("Your Content"). You retain ownership of Your Content.
By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display Your Content solely to operate and provide the App — including displaying it to you and to the other users you choose to share it with. This license ends when you delete Your Content or your account, except for content others have re-shared or for copies retained in routine backups.
You represent that you own or have the necessary rights to Your Content and that it does not infringe the rights of any third party.
We have zero tolerance for objectionable content or abusive behavior. You agree not to post content or engage in conduct that:
You can report objectionable content and block other users within the App. We review reports and may remove content and suspend or terminate accounts that violate these Terms, typically acting on reports of objectionable content within 24 hours. We may take action at our discretion to protect users and the integrity of the App.
The App offers an optional auto-renewable subscription. Pricing is shown in the App (for example, an annual plan). Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically unless canceled at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription in your Apple Account settings. Except where required by law, payments are non-refundable; refund requests are handled by Apple.
The App, including its software, design, and branding, is owned by us and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or branding.
The App relies on third-party services, including Apple (distribution, notifications, payments) and Supabase (hosting and authentication). Your use of the App may also be subject to those parties' terms.
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the App and its users. Sections that by their nature should survive termination will survive.
The App is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that location or travel data will be accurate.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the App.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, where appropriate, notify you within the App. Continued use of the App after changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable there, without regard to conflict-of-laws rules.
